Judge adds years to prisoner's sentence for VFW burglary

On April 27, a 44-year-old Michigan man already incarcerated for a string of burglaries was sentenced to three to 10 more years in prison for robbing the Bay County VFW in 2011. He pleaded guilty to the felony crime in February.

According to authorities, the Westland native broke into the VFW in Pinconning on the night of Aug. 26, 2011. He reportedly stole $725 and five boxes of candy bars valued at $125. Near the opened cash box, police found a discarded ice cream stick and wrapper which they sent to a crime lab for testing. The lab found DNA on the stick and matched it to the defendant, whose DNA was already on file from his prior convictions. Authorities requested a fresh DNA sample from the defendant in September 2012, but he refused. A warrant for a new sample was then obtained and executed, and the results again matched him to the DNA on the ice cream stick. He was charged with breaking and entering with the intent to commit larceny in August 2014.

The defendant is currently serving time at the Central Michigan Correctional Facility on five counts of breaking and entering and one count of safe breaking. He is not eligible for release until May 28, 2017, but he could remain imprisoned until May 21, 2062.

Michigan residents who are charged with larceny could face severe penalties if they are convicted. It therefore can be advisable for those who are so charged to consult with a criminal defense attorney as soon as possible. Legal counsel can examine the arrest reports in order to determine whether there have been any violations of the client's constitutional rights. In some cases, it may be possible to negotiate an arrangement with the prosecution that reduces or dismisses some of the charges in exchange for a plea of guilty to a lesser offense.
