Michigan law characterizes a first-time minor in possession (MIP) offense as a civil infraction. However, simply paying the fine will create a record. A second-time MIP or subsequent offense remains a crime. Penalties for the purchase, consumption or possession of alcoholic liquor by a person under the age of 21 include:

  • For a first-time MIP civil infraction, the fine is $100. The court may also require the minor to participate in a substance abuse program. If convicted of the infraction, any subsequent accusation may be charged as a crime.
  • For a MIP, second offense, the court may sentence the minor to up to 30 days in jail if certain conditions exist and impose a fine of up to $200. Again, a substance abuse screening and potential treatment are options the court may impose.
  • For a third or subsequent offense, the stakes continue to get higher, with a potential jail term of 60 days if certain conditions, a fine of up to $500, and additional terms related to chemical dependency.
